Terms of Service

1. Acceptance of Terms

By accessing or using Dunk AI ("Dunk AI," "we," "us," or "the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes means you accept the revised Terms.

2. Description of Service

Dunk AI provides basketball jump and biomechanics video analysis. The Service uses computer vision and AI to estimate jump metrics, provide technique feedback, comparisons, and coaching explanations. Features vary by plan. Growth Protocol and AI Coach are available on Elite only.

The Service is provided for informational and training purposes only. See our AI & Biomechanics Disclaimer for important limitations.

3. Eligibility and Accounts

You must be at least 13 years old to use Dunk AI. If you are under 18, you represent that you have permission from a parent or legal guardian. You are responsible for your account credentials and all activity under your account. Provide accurate registration information and keep your profile up to date.

Your active plan and feature access are determined by your account's subscription tier in our backend systems. Do not attempt to bypass plan limits or entitlement checks.

4. Plans, Limits, and Fair Use

Current plan limits are described in our Subscription Terms. At a high level:

• Free: 3 regular Dunk Mode analyses lifetime and 1 Max Effort (Vertical Test) analysis lifetime.
• Pro ($4.99/month): 10 regular analyses per month and 5 Max Effort analyses per month.
• Elite ($14.99/month): 20 regular analyses per month, 15 Max Effort analyses per month, plus Elite-only features such as Growth Protocol and AI Coach.

Paid monthly quotas reset each calendar month unless we state otherwise in the app or on the pricing page. We may enforce limits to protect service quality and prevent abuse.

5. Subscriptions, Billing, and Platforms

Dunk AI may be purchased on the web through Lemon Squeezy or on Android through Google Play Billing via RevenueCat. Web and mobile purchases may use different billing systems. Your purchase platform controls cancellation, renewal, and refund mechanics for that purchase.

• Website (Lemon Squeezy): governed by our Refund & Cancellation Policy and Lemon Squeezy's terms where applicable.
• Android (Google Play): governed by Google Play subscription and refund policies. Manage or cancel in Google Play subscription settings or through in-app subscription management where available.

Subscriptions renew automatically each billing period until canceled. Canceling stops future renewals but generally does not automatically refund charges already paid. Access usually continues through the end of the current billing period unless refunded or revoked by the payment platform.

6. Acceptable Use

You agree not to misuse the Service, including:

• Uploading unlawful, harmful, or rights-infringing content.
• Reverse-engineering, scraping, or attempting to bypass plan limits or security controls.
• Using the Service for unauthorized commercial resale or redistribution of reports.
• Sharing, selling, or transferring your account without permission.
• Uploading videos of others without their consent where required by law.

7. Your Content and Videos

You retain ownership of videos you upload. You grant Dunk AI a limited license to store, process, analyze, and display your content solely to operate the Service. You represent that you have the rights needed to upload and analyze your videos. See our Privacy Policy for retention and deletion practices.

8. Intellectual Property

Dunk AI owns the Service, including software, models, branding, design, and generated report formats, except for your uploaded content. You may not copy, modify, or create derivative works of the Service except as allowed by law or with our written permission.

9. Health, Safety, and Training Responsibility

Dunk AI is not a medical service and does not diagnose injuries or medical conditions. AI and biomechanics outputs are estimates and coaching suggestions, not guarantees of athletic improvement. You are responsible for training safely, using proper supervision when needed, and consulting qualified professionals for medical or injury concerns. See the AI & Biomechanics Disclaimer.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR FULLY ACCURATE RESULTS. Some jurisdictions do not allow certain warranty exclusions; in those cases, exclusions apply to the maximum extent permitted by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUNK AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE PROHIBITED BY LAW.

12. Account Termination and Deletion

You may delete your account in Profile Settings or via our Account Deletion page. We may suspend or terminate access for violations of these Terms, fraud, abuse, or legal requirements. Sections that by nature should survive termination will survive, including intellectual property, disclaimers, and liability limits.

13. Governing Law and Disputes

These Terms are governed by the laws applicable to Dunk AI's operating entity, without regard to conflict-of-law rules. Disputes will be resolved in the courts or forums specified by applicable law, unless mandatory consumer protections in your country require otherwise.
